Terms and Conditions

Starlite Express

1.  Starlite Ferries Inc. (SFI) shall transport documents, parcels or boxes via sea.

2.  SFI’s liability for lost or damaged shipments is limited unless the shipper declares a higher value at the time of shipment and pays a corresponding higher freight cost. Unless a higher valuation has been declared by the shipper at the time of shipment, SFI’s liability for lost or damaged shipments shall be as provided in Section 3.a.  

3.  SFI’s liability for delayed, damaged or lost shipment is as follows:

a. For lost or damaged shipments with NO declared value, SFI’s liability shall be limited to the refund of the freight cost, regardless of the actual content of the parcel.

b. For lost or damaged shipments with declared value, SFI’s liability shall be limited to the refund of the freight cost plus the value declared in the official receipt, regardless of the actual content of the parcel.

c.  For delay in the delivery exceeding seventy two (72) hours, liability shall be limited to the refund of the freight cost.

 

All claims for compensation under this provision must be filed in writing within five (5) days from date of transaction, otherwise the same will be barred.

4.  SFI shall not be liable for delay, damaged or loss shipments arising from acts of God, force majeure, intervention or actions of government authorities or breach of contract by the shipper.

5.  Except as provided under Article 3 of these terms and conditions, SFI shall not be liable for moral, exemplary and consequential damages.

6.  The shipper shall guarantee the following:

a. All information including names, addresses, declared content and its value of the shipment, are true and correct.

b. The shipment contains no hazardous, prohibited or illegal items such as explosives, firearms or its parts, ammunition, flammable, illegal drugs, live animals or other items prohibited by the law and which require government permit for its transport.

c. The shipper has designated/ indicated a consignee or person of legal age and discretion who will claim the shipment at the agreed date, time and port address.

7.  The shipper can check and verify the status of the shipment at any SFI Ticketing Office, or its Website, Social Media platforms or customer care hotline within three (3) days from date of acceptance for shipment by SFI. The shipment must be claimed within five (5) days from arrival at the port of destination, otherwise SFI reserves the right to dispose of the item and to apply any proceeds for the cost of its storage.

8.  The consignee or any person of legal age and discretion who receives the shipment shall check the shipment upon receipt, and the said shipment shall be deemed in good condition when its packaging is intact and without any damage. In any case, no claim for compensation shall be entertained unless a formal complaint is filed with SFI at the time of receipt.

9.  SFI reserves the right to open and check the shipment prior to acceptance in the presence of the shipper or its authorized representative to ensure that the shipment contains no hazardous, prohibited or illegal items. SFI in its discretion, may refuse acceptance of any shipment that is in violation of its safety / health policies or of pertinent laws.

10.  By transacting with SFI, the shipper warrants that he/she has understood and agreed to these terms and conditions for shipment by SFI.
